In short: these Terms of Service explain who can buy from us, how orders, payment and shipping work, and the rules for mystery items, live shows, giveaways and reviews.
These Terms of Service (“Terms”) apply to your use of scoops.spreema.com (the “Site”) and to every purchase you make from us. The Site is operated by Spreema, Inc., a Wyoming corporation doing business as Spreema Scoops, with an office in Houston, Texas (“Spreema Scoops”, “we”, “us”). By using the Site or placing an order, you agree to these Terms, our Privacy Policy, Refunds & Returns and Shipping Policy. If you do not agree, please do not use the Site.
Who can buy
You must be at least 18 years old, or the age of majority where you live, to place an order or create an account. Products made for children must be bought by an adult. We currently sell and ship only within the United States.
Your account
If you create an account, keep your password private and tell us right away if you think someone else has used it. You are responsible for activity on your account. We may suspend or close accounts that break these Terms.
Products and descriptions
We try to describe and picture every product accurately. Colors can look different on different screens, and handmade or hand-picked items vary.
Mystery items. Mystery scoops, blind bags, boxes and bundles contain items we choose. The specific items, colors and styles are a surprise and are not guaranteed, except for what the product description promises (such as the number of items in a size). Pictures of mystery products show examples, not the exact items you will receive. Mystery items are final sale, except as our Refunds & Returns policy says (for example, damaged or missing items).
Prices, orders and payment
- Prices are in US dollars and can change at any time before you order. Shipping and any sales tax are shown at checkout.
- Your order is an offer to buy. We accept it when we ship it. We may refuse or cancel an order, for example when a product is out of stock, a price or description was wrong, or we suspect fraud. If we cancel an order you paid for, we refund you in full.
- Pricing errors. If a product is listed at the wrong price, we may cancel the order and let you reorder at the correct price.
- Quantity limits. We may limit how many of an item one customer can buy, especially for live show spots and limited items.
- Payments are processed by our payment provider. You confirm that you are allowed to use the payment method you choose.
Shipping and risk of loss
Shipping times are estimates. Title and risk of loss pass to you when we deliver your order to the carrier. If a package is lost or damaged in transit, contact us and we will help with a claim and, where our policies allow, a replacement or refund. See our Shipping Policy.
Returns and refunds
Returns, exchanges and refunds follow our Refunds & Returns policy.
Subscriptions
If we offer a monthly box or another subscription, the product page explains the price, billing date, and how to skip, pause or cancel. You can cancel at any time before the next billing date, and we will not charge you again after you cancel.
Live shows
During live shows on our social media pages we open, reveal or play games with items customers bought. Buying a live show spot is a purchase of the items described for that show. A rescheduled show keeps your spot. If a show is cancelled and not rescheduled, we refund the spot or ship the items, whichever you prefer.
Giveaways
Giveaways are free to enter, and no purchase is necessary. Each giveaway’s own rules (who can enter, how winners are chosen and told, and the prize) are posted with it. Giveaways are void where prohibited. By entering, you agree that we may say your first name live or on our pages if you win.
Reviews and content you share
If you post a review, photo, comment or other content, you confirm it is yours and true, and you give us a free, non-exclusive, worldwide license to use, show and share it to run and promote the shop. We may remove any content at our discretion. Do not post anything unlawful, misleading, hateful, or that breaks someone else’s rights or privacy.
Acceptable use
Do not misuse the Site. That includes trying to break or overload it, scraping it with automated tools, using it for fraud, reselling live show spots without our permission, or getting around purchase limits.
Intellectual property
The Site’s content, including its text, photos, designs, logos and the Spreema® and Spreema Scoops names and cart logo, belongs to us or our licensors and is protected by law. Spreema® is a registered trademark. You may not copy or use them without our written permission. Product names and brands of items we resell belong to their owners.
Disclaimers
The Site and products are provided “as is” and “as available”, except where the law does not allow it. We do not promise that the Site will always be available or free of errors. We make no warranties beyond those in a product’s description and those the law requires. Nothing in these Terms limits any rights you have under laws that cannot be waived, including the Texas Deceptive Trade Practices Act.
Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, and our total liability for any claim about an order is limited to the amount you paid for that order. These limits do not apply where the law does not allow them, such as for harm caused by our gross negligence or intentional misconduct.
Indemnity
If you break these Terms or the law in using the Site, you agree to cover the reasonable losses and costs we suffer because of it, to the extent the law allows.
Disputes and governing law
If you have a problem, please contact us first. Most issues are solved quickly. If not, these Terms are governed by the laws of the State of Texas, without regard to its conflict of law rules, and any dispute will be resolved in the state or federal courts located in Harris County, Texas, or in small claims court where you live, if it qualifies. Each of us waives any right to a jury trial to the extent the law allows.
Changes to these Terms of Service
We may update these Terms. The version posted when you place an order applies to that order. We will change the effective date above when we update them.
Other terms
If any part of these Terms is found unenforceable, the rest stays in effect. If we do not enforce a part right away, we have not waived it. These Terms, together with the policies linked above, are the whole agreement between you and us about the Site and your purchases.
